In order to use Dynamic Internet's services, the customer will need to enter into a membership agreement with Dynamic Internet to establish an account. This agreement serves as a protection for both Dynamic Internet and its customers, as well as to prevent misunderstandings, and to provide the framework for a legal recourse in the event of a dispute or violation.

Upon requesting an account activation, customers are required fill out our application form, and agree to accept the terms, conditions, policies and disclaimer and by using the services of Dynamic Internet, the user agrees to the following terms and conditions. If a staff member either activates an account for you or fills out the application form on your behalf, you automatically agree to the terms, conditions, policies and disclaimer when your account is activated.

The customer agrees to pay by the due date indicated, the full amount of charges incurred for services provided as specified on all invoice(s) issued to the customer by Dynamic Internet.

Our services may only be used for lawful purposes. Customers are prohibited from posting any unlawful, libelous, threatening, abusive, harassing, disruptive, obscene material or message that would violate the rights of any person or constitute a criminal offense, or otherwise violate any local, state, national or international laws. Transmission or solicitation of any material which violates national and/or international laws which may apply in our local jurisdiction or your local area, is prohibited. This includes material which is or in any way a violation of intellectual property laws. Warez and Pornographic sites are strictly prohibited. Note: Sex-related merchandising is prohibited on all servers. This includes sites that may infer sexual content, display nudity or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited. In addition any site selling or promoting bulk email services is not allowed. Examples of non-acceptable content or links: Pirated software; Hackers programs or archives; Warez Sites; Irc Bots; mp3 or any other method of illegally distributing copyrighted video/music/sounds. We will be the sole arbiter as to what constitutes a violation of this provision. We reserve the right to terminate the Service for any reason.

You agree to indemnify and hold harmless Dynamic Internet in any legal action which arises as a result of your use of our services, without limitation or exception. Dynamic Internet makes no warranties or representations of any kind for the services being offered, including warranties of merchantability or fitness for any purpose. The subscriber hereby agrees to bear sole responsibility for all use of his/her account. You also agree to ensure that any forms you have on your site, have been written to prevent exploitation by spammers/hijackers. If it is found that a form has been used for such purposes - the said form will be immediately removed from your site and you must at your own expense have this form fixed. You agree not to hold Dynamic Internet responsible for any loss you suffer as a result of using our services, including but not limited to loss resulting from service delays and incomplete or interrupted service, regardless of cause. However, Dynamic Internet does agree to refund or credit its customers under the terms of our Service Level Agreement (SLA). No compensation will be made other than that outlined in our SLA. If your account is suspended by Dynamic Internet for any reason, or is in arrears, you are not covered by our SLA.

You agree not to maliciously or intentionally interfere with the proper operation of the system, including but not limited to defeating identification procedures, obtaining access beyond that for which you are authorised, and impairing the availability, reliability, or quality of service for other customers. You further agree not to interfere with the proper operation of other systems reachable through the Internet, including any attempt at unauthorised access. You agree that the security of your account or server is first and foremost your own responsibility and agree to bear sole responsibility for all use of the account and for the confidentiality of the password. You further agree that if you believe the security of your account or server has been compromised in any way, you will notify Dynamic Internet immediately. You agree that if you become aware of misuse of your account or server, and do not notify Dynamic Internet, you will be held responsible for that misuse. Accounts are expressly limited to the individual subscriber. Dynamic Internet will suspend access or change access to the subscriber's account immediately upon notification by the subscriber that the password has been lost, stolen or otherwise compromised.

60 Day Money Back Guarantee

All Web Hosting plans include a 60 day money back guarantee. If you are dissatisfied with your service for any reason, you will receive a full refund (excluding any over usage charges) if you cancel your account within 60 days of it's activation. Please be aware that there are no pro-rata refunds after the first 60 days of service - no refunds will be issued after 60 days. Accounts cancelled/terminated by Dynamic Internet for violating our Terms & Conditions do not qualify for the 60-day money back guarantee. For example, accounts cancelled due to spamming are not covered by the guarantee.

Dynamic Internet reserves the right to amend these terms and conditions at anytime with out prior notice.
